Before we talk about barristers, we need to know the proper definition of a lawyer. A lawyer is a man or woman who is authorized or licensed to represent member of the public in a court of law or to advise them on matters of law. A lawyer is also known as an attorney, a counselor, or a solicitor. A person who approaches a lawyer to seek legal services or clarification is called a client.
In the United Kingdom, a lawyer who has the authority to argue or fight cases in higher courts is called a barrister. It is therefore incumbent upon the barristers to see that all the matters of law and any facts which favor their clients; cases are brought to the notice of the court and ensure that justice is done.
Barristers are eligible to represent all legal matters, including contracts, wills and business matters. Some solicitors also attend exclusive and additional training so that they are accorded higher rights which enable them to appear in the higher courts. In the UK, normally the top 10% of barristers are denoted to be the Queen’s Counsel. This designation does not necessarily mean that they work directly for the Queen or even the government, but it is the recognition of their service, status and performance.
In order to perform impressively at the Bar, a barrister is expected to have exemplary characteristics such as being quick-thinking, have a high level of concentration, a disciplined approach towards work, analytical abilities, not stray from the subject, have oratorical skills, and be able to speak and write good English.
One has to do several years of study – needs to score highly in academics – before becoming a barrister. Once you possess the requisite academic degree, you are expected to pass the one-year Bar Vocational Course (BVC) which trains you in civil and criminal procedures, advocacy, and conducting legal research as also in drafting aspects.
Prior to joining the BVC, you have to join one of the four Inns of the Court namely, Middle Temple, Inner Temple, Gray’s Inn and Lincoln’s Inn. Next is the Pupilage stage which is really very tough and the competition is very high. After the pupilage, a barrister starts looking for tenancy which is a permanent position in Chambers. A barrister’s education doesn’t end here but is expected to carry out 36 hours of Continuing Professional Development (CPD) within the first three of his professional practice which also consists of 12 hours of advocacy and 3 hours of ethics.
